Automobile Accident Injury Claims

Car Accidents Causing Catastrophic Injuries, Serious Injuries or Death

According to the National Highway Traffic Safety Administration, more than 35,000 people lost their lives in crashes on U.S. roadways in 2015. That’s a 7.2% increase from 2014, the largest percentage increase in nearly 50 years. In addition, the number of people injured on our nation’s roadways increased in 2015, rising from 2.34 to 2.44 million people.

At Kitrick, Lewis & Harris, we understand how overwhelming an accident can be. You are dealing with the trauma of the accident, the emotional anguish associated with a catastrophic injury or loss of a loved one, mounting medical costs, potential lost wages, and a legal system that moves slowly and is difficult to navigate.

We see that you receive financial compensation for your pain and suffering, and relief from the medical expenses you have incurred because of the accident. We provide the compassionate counsel you need and deliver the results you deserve.

Common Causes of Car Accidents

  • Drunk Driving
  • Fatigue and Distracted Driving
  • Reckless Driving

Every accident is unique. However, in the vast majority, someone is to blame. Our attorneys can review your accident to determine whether you should take legal action. There are many reasons for automobile accident injury claims. We have handled over 10,000 accident cases and are incredibly qualified to help you. We have also written and lectured and been leaders on many of the issues that are involved.

According to the Centers for Disease Control and Prevention, 28 people die each day in the U.S. due to a motor vehicle crash involving a drunk driver. Despite new laws prohibiting the use of a cell phone while driving, people continue to do so. We do lectures on distracted driving to try and prevent others from being hurt or killed. Other distractions such as eating and drinking, grooming, and using a navigation system lead to serious and/or life-threatening injuries. Every day, reckless drivers speed or drive too fast for conditions, and pose serious threats to motorists.

Securing Compensation

Uninsured and Underinsured Motorists

If you are hurt in a car accident caused by another driver’s negligence, you have the right to expect compensation for your medical bills, lost wages, pain and suffering and other losses. Generally, your costs and general damages are paid by the at-fault driver’s liability insurance when you make a personal injury claim. This is called a “tort claim.”  Unfortunately, many drivers carry only the minimum liability coverage required by Ohio law.

If the uninsured or underinsured driver who hit you has only the minimum liability insurance, it may not cover all of your losses. If you carry uninsured or underinsured motorist coverage (UM/UIM) coverage, which we suggest that you buy to best protect you and your family, we will make a claim against your own insurance company to cover the balance of your losses. This is called a “contract claim.” It is a highly complex series of laws and most people do not understand the nature and extent of these types of cases.
